Which benefits apply to my 2015 to 2022 NHS service under the McCloud remedy?

Service between 1 April 2015 and 31 March 2022 was moved back into the 1995 or 2008 section from 1 October 2023. Affected members choose whether that service earns legacy benefits or 2015 scheme benefits. The choice is made from a Remediable Service Statement, which NHSBSA expects to send by the end of June 2030 at the latest.

How the benefits differ

1995 section
For a practitioner, 1.4% of revalued career earnings each year, revalued at 1.5% above the Pensions Increase figure. A lump sum of three times the pension is paid automatically. Normal pension age is 60.
2008 section
For a practitioner, 1.87% of revalued career earnings. There is no automatic lump sum. Normal pension age is 65.
2015 scheme
1/54th of each year's earnings, revalued each 6 April at CPI plus 1.5%. There is no automatic lump sum. Normal pension age is your State Pension Age, or 65 if later.

The choice and its timing

The annual allowance for 2019/20 to 2021/22

Moving service back into the legacy section changes the pension growth in those years, so NHSBSA sends a revised annual allowance statement. A revised charge, or a refund of one already paid, goes through HMRC's Calculate your public service pension adjustment service and covers 2019/20 to 2021/22.

Members who were already retired on 1 October 2023 have until 31 January 2027 to report through that service, and until 6 July 2027 to elect scheme pays for a revised charge.

A retired member who does not reply to their Remediable Service Statement within 12 months keeps 1995 or 2008 benefits for the remedy period.

What is the McCloud remedy period?

1 April 2015 to 31 March 2022.

What happens if I do not make a choice?

For a retired member, 1995 or 2008 section benefits apply to the remedy period if there is no reply within 12 months of the statement.

Does the remedy affect my annual allowance?

It can. Pension growth for 2015 to 2022 is recalculated, and HMRC's public service pension adjustment service handles the revised position for 2019/20 to 2021/22.
